WHAT DATA DO WE COLLECT FROM YOU AND HOW?
Move Evolution collects various information about you to enable us to provide you with the best possible care. This includes the following:
- Information provided by you when you first get in touch with Move Evolution, for example name, email address, phone number, address, date of birth, bank details, health information and medical history;
- Information provided by you or on your behalf with your consent (for example by your GP or physiotherapist), including medical history and treatment notes;
- Information generated through your sessions with Move Evolution, such as notes from the sessions.
HOW DO WE USE YOUR DATA?
Move Evolution uses information about you for the following purposes:
- Provision of services. We use the information about you to design sessions and exercises tailored for you;
- Communicating with you. We use your contact details to arrange and confirm your sessions, send you videos of your exercises and communicate between us on your movement progress.
HOW DO WE STORE YOUR DATA?
Move Evolution has a legal obligation to retain your records for 8 years after your most recent session but after this period you can ask us to delete your records if you wish. Otherwise, we will only retain your records for as long as is necessary for the purposes set out in this Privacy Policy.
Your records are stored on our computers, secure servers managed by our service providers, and occasionally hard copy files are kept in a secure location. Personal information that we store or transmit is protected by security and access controls, including username and password protection, two-factor authentication, and data encryption where appropriate.
WHO DO WE SHARE YOUR DATA WITH?
Move Evolution will not share personal information about you with any third party without your written consent.
YOUR RIGHTS
You have a right to see what personal information about you we hold, and to request us to correct any factual errors. Provided the legal minimum period has elapsed, you can also ask us to delete your records. If you feel that we are mishandling your personal information in some way, you have the right to complain.

SERVICES
The exact services we will provide to you will depend on what we agree during the initial consultation and throughout our sessions. The initial consultation generally involves talking about your needs and medical history with us, an evaluation and examination of your needs and issues and developing a programme of recommended actions to address your needs and requirements.
Our aim is to provide our services using reasonable care and skill, but it is not possible that any particular result or outcome can be guaranteed as a result of our services. Some issues may take longer than others to treat and we will regularly reassess the action plan.
SESSIONS
If we have not agreed the number of sessions to be provided, we shall provide sessions on a session-by-session basis. We will agree the date and time of the first session and any subsequent sessions by phone, text, in person or by e-mail.
EXERCISES
We may set you exercises to be completed between sessions. You are not obliged to complete these exercises but if you do not complete them, your progress may be slowed down.
FEES AND PAYMENT
Our fees for each session and the associated services are as confirmed by us to you. Payment for our services is due at the time, or on the day of the session. We accept payments by cash, cheque and bank transfer (BACS). Payment remains your responsibility at all times and where possible you will receive a reminder in the event of non-payment of a session.
CANCELLATIONS
If you have booked a session and you cancel with less than 24 hours’ notice or do not turn up for the session, then you are liable to pay the cost of that session. We recommend that all cancelled sessions be rescheduled to ensure consistency, fitness and movement progress.
On occasion, we may have to cancel a scheduled session. If we have to cancel a scheduled session, we will book you another session as soon as reasonably possible. No charge will be made to you for the session cancelled by us.
CONFIDENTIALITY
We will treat all personal information provided by you as confidential. We will not share such information to any third party without your written consent, except where required by law or where action might be necessary to protect you or someone else.
LIABILITY AND INDEMNITY
Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount (and not exceeding the amount you pay in total for our services), having regard to such factors as whether the damage was due to a negligent act or omission by Move Evolution. Nothing in these terms and conditions will limit our liability for death or personal injury caused by our negligence or fraud and fraudulent misrepresentation.
We will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, or for any loss of profit, or for any indirect or consequential loss arising under or in connection with our services. Except as set out in these terms and conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the contract.
You agree that you will indemnify us against any and all loss or damage suffered, including any legal fees or costs, as a result of any breach of this agreement by you.
